Going into a second day, tomorrow afternoon.

Can't read much into that. Seems the QCs for the league and the three promoted clubs argued strongly that the appeal should be heard by the SFA. Hearts/Partick are arguing that the arbitration act in Scotland allows them to go to court. Hearts/Partick will continue presenting their argument tomorrow.

The hearing resumes at 2pm today.

Again, this will only decide whether the case goes to a full court hearing or is dealt with by the SFA's independent arbitration process. An out of court settlement also remains a possibility.

In Belgium, this morning's press reports that there is increasing support within the league to overturn Waasland-Beveren's relegation and run the top flight with 18 rather than 16 teams (so they'd also promote the two clubs who were playing off to replace W-B ). This course of action would probably mean the legal cases can be brought to an end.

Major development in Belgium today and it's not good news for us.

The Belgian Competition Authority, which had ruled Waasland-Beveren's relegation illegal, is not supporting their reinstatement into the top division because it would give them "a disproportionate advantage". Presumably because this would mean they'd be allowed to survive despite being two points adrift with one game left.

Playing the final game has already been ruled out as an option.

The case is also with the Belgian Court of Arbitration, who delayed their verdict pending the opinion of the Competition Authority. Their final ruling is due soon but this may well be a hammer blow to that.

That'sit then AM.
We just have to dust ourselves down, learn lessons - no more of this football family crap - and look after ourselves.
We have "the list" as well.

The killer for Waasland was their refusal to play the remaining game that could have saved them. Competition law rightfully considered that as unreasonable.

Our situation is different.

Anyway looks like a turn of events in our favour following Parry and his big mouth.

Yes, I also think they were pushing their luck because they were two points adrift and had a stinking goal difference, and only one game left to play.

Also I'm not sure if the original decision of the league was based on a vote of the clubs or was just taken by the league itself. If it was by the league itself then Beveren wouldn't really be able to argue unfair prejudice....whereas we can.

Meanwhile the club still awaits a ruling from the court of arbitration. That is due soon and might well be the final nail in their coffin.

Exactly. Our case is different.

I was about to give up and concentrate on league 2, but this latest "not quite right" Parry development has changed things. Even this tampering with club twitters on EFL in advance of the voting looks very odd behaviour. Anyway its in the hands of others now.

The Scottish court has ruled that the Hearts/Partick case should be heard by the SFA's arbitration, not by the courts.

That probably reduces the chances of us litigating.

Agreed. The League will deal with Parry. We should just focus now on EFL2 next season. The experience this summer has hardened us, and made us wiser. The last 3 years has been quite a ride.
Lets go again!

Hearts did not get the courts approval to ruile on their case but the 3 promoted teams also did not get what they wanted as the courts refused to dismiss Hearts case.So now has to go to arbritration and both sides have to disclose all documents ---- could be interesting for the EFL though they will probably lose them... nice summary here..
