Youtube lose german court case

A german court has ruled that Google's video-sharing service Youtube is responsible when users post copyrighted music clips without permission.

The german royalty collections body GEMA sued Youtube over 12 specific music videos to which it holds the rights.

The test case could have juge implications for Youtube it is has to pay royalties for all clips posted on its website

Bit of a blow for freedom on the net. Youtube will now say that it has to vet every file that is uploaded before its hosted on the site. Cue censorship.

it does seem to be all part of cutting down freedom on the web, big efforts to stop streaming underway too

I think it is so stupid. It has nothing to do with copyright or things like that, it is just question of Money - the more you have, the more rights you got.
If I could win the jackpot on the EuroJackpot, I definitely know what I would do with that money

Knew this would eventually happen..its only a matter of time with ip addresses and access available by pretty much the big companies

but as far as the thread, its an infringement and youtube should be paying for use of peoples music just like everyone else is LEGALLY bound to do

companies have used the internet to get around paying artists for years now...I mean the amount of music that is played daily on youtube and the artist that created that doesn't get anything...its ridiculous

Radio, Clubs, Restaurants, Jukeboxes, TV, Film, Musical Cards etc all have to pay...why not Youtube

The difference is Rockstaar, that the payment by those entities is prospective not reactive. Its not like clubs have to pay royalties if a patron walks in and starts to play a Michael Jackson song. Youtube hosts peoples videos in much the same way, it merely gives a platform in which people can enjoy socialising their media.
I dont mind musicians getting their pay day but its what this case will lead to that irks me. If the courts now demand that websites who freely HOST information but are not taking an active role in content publication have to pay- the only way that youtube can combat that is by screening everything that it publishes, which is the first step towards censorship.

It's merely a way to justify censorship, by hook or crook.

good point Zainy and Billy

I think we were always in danger of censorship once everything is so connected..that said

Thing is YouTube is built on infringement of peoples property. You simply cannot use an artists work without his/her permission and paying them for it

YouTube is a commercial company that charges for advertising, therefore they should be liable to pay the artists for their work

Prince pulled his stuff from YouTube for this very reason, which prompted YouTube to pay artists for views and comments

I mean you can't start a television station thats seen by millions of people and say that you bought the music you are playing, so you are simply sharing it, therefore you shouldn't have to pay royalties...doesn't work that way

Ahh I do understand that Rockstaar, and yes the law should be followed with regards to this.
But should the responsibility lie with YouTube or the person uploading? Of course if youtube creates a channel and is affiliated with it then of course YouTube should be paying out royalties.

of course the responsibility lies with YouTube...its their platform...simple

They filter all kinds of stuff on there...so they should do the same with music...I mean if Soundhound can tell me what song is playing within 30 seconds, I don't see the problem
